Abstract: The article discusses the meaning of bad faith prosecution and provides a taxonomy of different types of claims of bad faith prosecution and the procedural settings in which they arise. Topics include the focus of claims on prosecution motivated by race or speech, criticisms that the standards of proof for bad faith prosecution claims are too high and inconsistent with other claims involving subjective ill will and the possible impact of progressive prosecutors on bad faith prosecution claims.
